1. APPLICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE
Terms and Conditions should be read by the Customer before making an order. By submitting an order on this website you are agreeing to the terms that appear below which will apply to any purchase made on this website. Purewei reserves the right to modify the present Terms and Conditions in part or in full, at any time.
2. PURCHASE CONTRACT
2.1. This website is operated by Triplewei Ltd (hereinafter also referred to as “we”, “us” or “our”). All purchases made on this website are governed by these Terms and Conditions.
2.2. We sell goods only to end-user consumers. All goods are sold subject to the condition that they will not be re-sold or otherwise circulated without our prior written consent.
2.3. We will confirm acceptance of your order. This will be by us sending an e-mail to the email address you have provided to us. At this point the purchase contract will be made and we will supply the goods to you in accordance with your order and these Terms and Conditions.
3. CHARACTERISTICS OF THE MERCHANDISE ON OFFER
3.1. The products on offer to the Customer are those listed in the catalogue published on this Website. The offer is limited to available supplies and contingent upon proper website operation.
3.2. Each product is presented accompanied by a photograph and a description written by Purewei these descriptions, intended to provide the Customer with key product characteristics before the finalization of any order, may not be used as grounds for any liability action against Purewei in any way whatsoever. The product photographs, provided for informational purposes only, are not contractually binding.
4. ORDER PLACEMENT AND CONFIRMATION
4.1. To order, the Customer undertakes to complete details required to process the order properly:
- Specify desired product(s)
- Order validation after verification
- Payment as provided by the terms and conditions
4.2. Purewei will confirm the order and the payment :
On the website, once payment has been made by e-mail, to the e-mail address indicated by the Customer
4.3. Purewei reserves the right to refuse an order if the Customer fails to fulfill any one of these obligations. More generally, and for any reason whatsoever, it may refuse any order that appears abnormal or incomplete. No order is final until it has been confirmed by Purewei. Purewei will confirm its acceptance or non-acceptance of an order within 3 business days starting when the order was entered at the website.
5. MEANS OF PAYMENT
5.1. Products may be purchased at the website with internet banking via a secure payment system run by the banking institution. Customer cannot pay for an online order by cheque. There is no minimum order requirement.
5.2. To process your order, the order must be paid in full.
6. RECORDS
Purchase orders and invoices are kept on computer, under reasonable security conditions, for Purewei.
7. THE RIGHT TO CANCEL A CONTRACT
7.1. The consumer’s right to cancel a contract within 7 days does not apply to contracts bearing on the supply of perishable food products like those sold by Purewei. Therefore, the Customer is not entitled to exercise this right.
7.2. However, it is not possible to honor a change or cancellation made by the customer if the product is in the preparation stage. We determine whether this is possible on a case-by-case basis.
7.3. However, once the package has been turned over the package, it is not possible to honor any change or cancellation. Here, the Customer’s account will not be credited with the order amount.
8. SHORTAGE OF SUPPLY
8.1. The supply of products available for online sale is limited. The name of any product that becomes unavailable will be removed from the online sales catalogue as soon as possible.
8.2. If there is a shortage of a particular product, Purewei will call or e-mail the customer as soon as possible to find a solution:
postpone supply until the product is available again, if and when this is possible replace the product with one that is comparable in terms of quality and price
8.3. Purewei products are made by artisans, which means that the supply is limited
Please note : The risk of product unavailability is higher during holiday periods (especially the year-end holidays) than during the rest of the year.
9. PRICES
9.1. The prices listed on the purchase order are in NZ dallor, inclusive of GST.
9.2. We charge separately for delivery when Purewei delivery service is available. The rates depend on the final destination, package weight and package volume.
10. COMPLAINTS AND REFUNDS
10.1. Purewei are committed to providing an excellent service. If however, we have sent you products that you are not entirely happy with, please contact us with your comments. We need to know where we can improve our service and products and will do all we can to put it right for you. Any comments and customer complaints should be addressed to us via the e-mail address which are listed on our website on the “Contact Us” page.
10.2. We guarantee the quality of our products. You must inspect the products and notify us promptly of any dissatisfaction with your order in the time of order pick up. We will promptly and fully refund the cost of any products if one of the criteria set out below applies to the product/s to you:
- The products are not what you ordered;
- The products are damaged or defective;
- The products is of an incorrect quantity; or
- If you do not receive the products ordered
10.3 .We will only process complaints received by us within 24 hours of pick-up, given the perishable nature of the products
10.4. We will arrange with you for the products to be returned to us. Any refund or credit will be made within 21 days. We reserve the right to make any refund due to you in whatever way we choose.
11. PRODUCT GUARANTEE
11.1. Purewei guarantees that its products are produced and packed following strict quality control rules and stored in compliance with current New Zealand standards.
11.2. However, Purewei cannot warrant the quality of its products if the Customer does not ensure optimal storage conditions or consumes products within 2 days of pick-up.
12. INGREDIENTS IN OUR PRODUCTS
All our products are made in an environment where nuts, flour, milk and eggs are used.
13. INTELLECTUAL PROPERTY / COPYRIGHT INFORMATION
13.1. All of the elements used on the Website (photographs, illustrations, pictograms, descriptions, logo, trademark) are and remain the exclusive intellectual property of Purewei.
13.2. None of the elements used for the Website (e.g. software applications, visual components or audio material) may be reproduced, broadcast, exploited, circulated or used in any way whatsoever, either in part or in full, without express prior authorization from Purewei, which holds all of the copyrights.
14. PROTECTION OF PERSONAL INFORMATION
14.1. When a Customer makes an order on the website, this signifies that he agrees to allow Purewei to use his personal information. This information is required to process orders properly.
14.2. All of this information is processed with care and treated in strictest confidence.
15. NOTICES
Unless otherwise expressly stated in these Terms and Conditions, all notices from you to us must be in writing and sent to us via the email address listed on the “Contact Us” page on our website. All notices from us to you will be displayed on our website from time to time.
16. INDEPENDENCE OF CLAUSES
If one of the present terms and conditions is found inapplicable or is invalidated for any reason, this fact will not affect the application or validity of the other provisions contained in the general terms and conditions. A term or condition that has been invalidated or found inapplicable will be replaced by a clause that is as close as possible to it.
17. FORCE MAJEURE
17.1. Neither Purewei nor the Customer may be held liable for any failure or delay in the performance of any of the contractual obligations set forth in the present Terms and Conditions. if said failure or delay is due to a case of force majeure.
17.2. Here, force majeure is taken to mean any external, unforeseeable and irresistible event. The following are expressly considered to be cases of force majeur: Full-scale or partial strikes, lockouts, riots, civil unrest, insurrection, war, severe or unusual weather conditions, epidemics, the interruption of transport or supply for any reason, earthquakes, fires, storms, flooding, water damage, governmental or legal restrictions, legislative or regulatory changes in the business environment computer failures, the interruption of telecommunications including the operation of telecom networks, any change in the basic mathematical principles governing the theory of cryptographic algorithms, used for public key infrastructure and any other case beyond the control of the Parties preventing normal performance of the contract.
18. GOVERNING LAW
The present terms and conditions are exclusively governed by New Zealand law.
